It means they are probably uploading the 179,000+ denials compared to the 146,000 payouts to show BP that they are in their corner.

It could also mean that they are creating an event to highlight a error they have in the database. Simply put they are doing a CYA, because by limiting access to the Claim Details Information file for so long, they were in violation of the following Claim Holders rights that they established.

Then again, that Bill of Rights has been violated many times over especially for any one who came from the BP claims process and did not receive a decision until November or December. That is why the 90 days was added to the final protocol,.

Or maybe it means that the GCCF feather weight IT department is doing a security sweep to make sure all claim holders information is secure, from claims holders buy easily accessible by BP and others having a curiosity about our SSI#s TAX ID, etc.

But then again with Feinberg being paid $850K a month by his client BP,  I’d say it is his badge of honor denial rate post. Remember Feinberg & Rozen have a duty to their client that must be met under the law. That puts claims holders behind the eight ball.

It means that they are continuing to violate each and every claim holders bill of rights. Rights established by Mr. Feinberg to reflect a fair system of recovery.

The specific rule being violated is.

Then again who here believed that we would be given a fair deal once Mr. Feinberg released the information highlighting an $850,000.00 monthly payment to Feinberg & Rozen by their client BP.

The importance of the payment to the Feinberg & Rozen law firm is this. Every lawyer owes a duty to a client to act in their best interest, even if the attorney has access to damaging information that would injure the clients, a set of rules, (cannons) restrict the law firms power to do anything but act in the best interest of their client, BP.

We are not Mr. Feinberg’s clients, we are the plaintiff and BP is being defended at the tune of a denial rate og 67% of all claims.

That is the short answer.

I filed my claim on November 22, 2010 and on Sunday December 5th online my status said review so I called a customer service rep to find I was denied on Dec 4. To this day my claim still reads under review. So my advice to anyone in this situation is to call customer service. Also I just sent a letter to them after sending in my tax doc for them to review my claim again. How did you go from denied to paid?

My heart goes out to you.  I am still waiting for an answer (over three months) and if I am denied, I will be forced to close my business also. 

The government has a website where there are many jobs for FEMA and other agencies.  Maybe this is the only safe way to work to get paid.  So much for tring to make it on our own.

Best of luck to all of you.  I have gone from hope to total dispair.

My claim was DENIED today. So I called to see if I could speak with a case manager or something as everyone in my industry was approved in my area as of the last time you could access the data on their site. She went through my file and informed me that all of the financials I sent in were unreadable. So they denied me because their machine couldn’t read the version of .pdf I sent in but nobody called me to tell me that…pisses me off big time!

The GCCF under the new protocol will have the ability to deny 73% of all claims. The current rate is 67% denial rate.
The magic number they are shooting for is75% denial , or a one in four pay rate.

Not an opinion actual numbers available from the Program statistics page in the Overall category at the top of the page. 67% denial is a massive push through of claims, similar to the robotic foreclosure rate seen recently.

I’d suggest everyone ask for the name of the adjuster who viewed your claim, and a copy of the notes exchanged between adjusters and management regarding your claim. It can not be considered a private product produced for a client, or Feinberg & Rozen would have to release a statement exposing their representing BP while acting as an advocate for the Claimants.

Does anyone here feel that the GCCF has been an advocate for their best interest in this process? Don’t be afraid to say yes, or No.

I shut down my business on October 28th the same day I was notified I was denied. 

I’m so sick of seeing those BP ads that are running with “BP making it right” and the shrimper and young couple that keeps telling the world that BP took great care of their cafe and they fed the BP workers so they would not have to close their business.  It’s not telling the real world what real hardships people are going through down here.  This is false advertising at the least.

Anyone up to making their own commercial?  I have the cameras and the web servers that I can run videos and commercials 24-7 on the web.  I can loop the commercials to run on Ustream and several other sites.  I’m willing to make as many commercials needed.  They don’t need to be 30 second we can make them several minute ones and up to 15 minutes if needed. 

I’m in Pensacola so anyone from Gulf Beach to Orange Beach I’m willing to drive and shoot the commercial and help get your stories out.  They say safety in numbers…lets show them how many businesses and people they have really damaged.

I just had to laugh.

I sent a letter to the individual who is assigned to speak to me. (not with me) with a list of the GCCF generated Claimants Bill of Rights that have been violated by the GCCF Administrative branch.

I was sent the standard e-mail form with one sentence explaining that my EAP claim was denied. The rest was standard fluff with advice that I could use the Coast Guard if I wasn’t satisfied with the service offered by the GCCF.  Ah thats why the GCCF was put in place wasn’t it, to keep any additional tax strain off the US taxpayers?

Then the rep called me and left a message asking to send her an e-mail with a time for her to return my call. Since we all know how that conversation goes, I think I’ll pass on the verbal denial, after hearing that from Mark at Feinberg & Rozen offices in DC, November 29th.

Not once was the issue of the three Claimants Bill of Rights violation addressed. It would seem that the Claimants Bill of Rights has penalty for violation, and no apology or defense to the violations.

If President Obama feels that his appointment of Mr. Feinberg was the magic needed to bring a sense of fairness and honesty to the process, I think it is closer to Voodoo, than Disney pixie dust.  I thought the use of necromancy was finished when Dick Cheney left the White House, but here we have another corpse in a suit, doing the bidding of BP & the White House.

So final claims it is. Funny thing is, my original claim was filed with the Final Claim category selected in Exhibit A.

Please remember that you can send your videos to CNN I-news and many other channels for airing free of charge.

It’s possible that any business that was forced into closing might have a special case against the defendents.

Speaking to an attorney might be in the best interest at this point.

After being under review for the past 6 weeks - I just called 2 hours ago - and mine has been DENIED - I own a photography business 5 minutes from the beaches of Destin - I’ve been in business for 20 years and this summer when the tourist didn’t come - my phone stopped ringing - we are now in foreclosure and about to loose everything—I just called Feinburg’s office and my state senator - next I’ll be in touch with a lawyer to file a lawsuit—I am not gonna go away.

They tell me I will receive a letter telling me what I can do - for example - to file a FINAL CLAIM - tell me - what kind of sense would it make to file a final claim when an emergency claim has been denied ????

There is NO LEGITIMATE reason they can give me for denying my claim !  And like everyone else has already stated - there are tons of individuals that made claims and been paid that shouldn’t have !

@Katrina…..After reading your post I checked my status and it still read “under review” since Oct so I called and was told by the rep. my claim had been denied, but she could not locate where they had mailed a denial letter out to me…I questioned why my status still showed under review and she had no answer…..I called back 10-min. later spoke with another rep. to try to find out what date I was denied and he quoted to me he didn’t see anything saying I had been denied, he still showed me being under review so that lets me know they are telling claimants anything!

At Timothy, and if you call for a third time you would get another different answer. Don’t give up till you get a letter in the mail. I have been in this since the beginning with BP and it’s been a nightmare.. All the way around. I am a oyster deckhand from Belle Chase,La.. And my advice don’t believe the computer nor those incompetent prompter reading folks.. Also they have had more cliché‘s in the system with status.. don’t give up hope…

IS THERE A SANTA CLAUS ?
I am sitting here wondering if there is going to be any Christmas magic for the gulf oil spill victims. We grew up believing that miracles can happen   But mostly at Christmastime There are people out there losing everything they have worked so hard for they did what they were told follow your dreams anything is possible. Then one day something that is out of our control happens and we lose it all in one moment. We do what we are told by Gulf coast claims facility followed all the procedures , paperwork to no end and nothing seems to happens. So now I go back to what we were told as children Christmas is a magical time miracles can happen .So now I say my prayers and wish upon a star that everything I have worked so hard for I will not lose and that I can still believe in the American dream .If this is time for miracles. I would like mine and all the other victims would too. It seems like Kenneth Feinberg is our Santa Claus and he needs to check his list we have not been naughty it is was BP.

Well said bravo BK Beach!  Although I was paid 2 months out of six bc I choose to do month to month. Worst descion in a long time! I’m greatful to an extent. Still waiting on my remaining four! only 12k under review as of yesterday at 5:05…REALLY?? They reviewed 12k claims in one day??? Because the day before it was 24K??? Those 24 workers in DC doing final reviews have some fast ass fingers flipping threw 12k claims in a day!! It crushes me to read all these people with 100% illegitimate claims being denied and closing business. It also is worst time for all of this to happen to all of the families. The Holidays!! All I can say to people that were denied do your best to go public and state your case to any kind of media. I think Feinberg should be stripped of his 850,000 his making a month once it’s reviled that people with legitimate claims were denied!! Take that Grinch!!!!

I sent in my “additional Documention” Seven Times! Seven Times they can not find it even though I have email verification they have recieved it. My kids are waiting and so is the bank on my home! Yet when I call again today to be told just because we can’t see your documention does not mean we can’t see it! What does it take. Doeas it take the starving masses to gather at BP’S corprate office or should we send our presentless children there and they can tell my three sons that once again they have lost my 56 pages of supporting documents. He is just trying to stay in th 20 billion dollar budget and maybe he will recieve a bonus depending on how much is left. Merry Christmas Fienberg to your children!

and if things are so fine here in the guld then why did and eighth of a mile sheet of tar wash up on the beach not to far from my home. My husband asked me why won’t you take your children to the beach. Thats all I need three boys bleeding from the rectum with staff infections. Another thing that GCCF won’t pay for. Also I love how they posted on there site that mental anguish will not be compinsated while he drives the people of the gulf coast father and father in depression. Who will pay for those claims?

Hey folks remember that Claims Details Information file that was put into an “available shortly, ” state.

The GCCF solved that issue once and for all by eliminating access altogether. Now even the link has been removed.

Not that the file is not being updated, it is just not being offered to claimants.

@ jen!! When I say I’ve been through it all with these clowns I mean ALL!! From BP not sending me a packet telling m they generated a GCCF # and postponing me a month and a half for my claims to be merged with my documents. To sending ALL FIVE of my supplemental claims in BOTH pages as 5 SEPARATE email attachments only to find out two months and a half months later only 1 full 2page supplemental and the front page of my 2nd supplemental was uploaded!!!!! REALLY???? Postponing yet again!!!!!! I have a confirmed NOREPLY email from them saying they got my email!! It had all five attachments and still do in my old emails!! But do you think there mistakes can made up??? NO…. The customer service/ person reading verbatim off a prompter can help you?? NO….. Nor can the people you email… They choose to only answer some emails!! I have proof that they only answered some emails and choose to ignore plenty of mine!!!! NIGHTMARE is an understatement….........

Yea claim details!! How about for one week all Five of my supplementals was broke down under status as under review!!! Then all of a sudden and to date its been only one claim showing instead of all six boxes, just one showing paid!! Of course they one to show that one month that was paid!! And then I’ve been having to call everyday since to check the status!! FUN FUN…..then a few customer service reps said that it never was like that and it was un true that it was never broke down individually!! That it was all classified under one line…. REALLY!!!  I can go on and on every time someone post something i can relate! Its sad truly sad!!!!!!

When you thought things could not be any crazier with some of the stupid claims that GCCF have paid to some people… read this one

I just went to have my dog bathed at my local groomer.  I’ve taken my lab there for the past two years once a month.  Not necessary to have her bathed but she is fussy about having her nails clipped so it is easier on me not to hurt her when doing this.  I arrived this morning and my groomer had on a t-shirt with a printed check copy on it from GCCF.  She blew up the check she received from GCCF and had it printed on a t-shirt.

She is displaying it proudly… the sum paid was for $17,000.00 The check is dated November 19th, 2010.  Now given she is a DOG groomer.  She works 3 days a week and her fees are $35.00 a dog. 

Her location is north Pensacola so she is at least 15 miles from any beach. And north of I-10 to boot.  Let alone any tourist area.  If you take $17,000.00 and divide by $35.00 that equals out to 485 dogs she claims she didn’t get to bathe.  She doesn’t take credit cards only cash or checks so she can finagle any number she wants for income tax purposes.  I’m really baffled at who is handling these claims and processing them.  The whole process is a lottery..some win some lose. 

I will not be taking my dog there ever again.  And she didn’t get a tip from me today…

Don’t do that to her.  I have seen shrimper that was honest and stated that they lost $200 per month and only making $7 per hour.  They have received payments anywhere from 12K to 24K.  GCCF is making the over payment.  As you can see, the local groomer had nothing to hide and told the truth. Besides, Feinberg did state that locations was not considered for a claim. How are we supposed to get the truth but we cannot get upset when we hear it.  I think that was a good idea the groomer did to let the world know how the GCCF if full of it and to fight for what you are owed.  Again, that was a good idea. Don’t forget that the GCCF no longer showed the status page because this is what they are hiding.

Rachel, please don’t be mad at the Dog Groomer because actually she is helping everyone’s case by not hiding what she received and eventually he will have to answer to someone regarding all the discrepancies in payments. Rachel, try to remain positive, although, I know it is very difficult right now:)

I’m going to file an interm payment request but not till after I know what my complete loses are for 2010.  Yes I can guess but I will have my W-2, 1099’s and all my year end tax records.  I found it really strange they are cutting off the first interm payment quarter December 31st becasue people won’t get their W-2’s to show exactlly what they lost for the year.  And then again you will have to wait for up to 90 days for any answer so they can really spread out any payments until ater April.

Be sure to print these comments as they will probably serve as cause to seopena records for a lawsuit due to inequitable treatment of claims.

I know of two wait staff employees who overdosed with their $28K each.

It appears there was a sweet spot of time when the GCCF was under pressure to get as many claims paid as possible, so they did.

Now it appears they are under pressure to minimize the amount of money that would have to be paid to the 4x more than expected claimants.

It seems simple - once they were generous and now they are tight.  When the attorneys finally get into the facts, there will have to be more money paid than they want to.

I have begun to request information regarding the review process my EAP claim went through to address the weakness they based a denial upon. I have also requested the GCCF explain why the Claimants Bill of Rights posted on the GCCF website has been continuously violated by the GCCF.

Not having a thing to hide,  on the third attempt to gain an answer to my questions I did a cc to the Assistant US Attorney General.

i’m very interested in the answer to what the remedy is when the GCCF violates its very own Claimant Bill or Rights.

Oh, and just so everyone is clear about what I am looking for in the process. I do not want an approval if I do not offer enough information to gain an approval, but I do want the GCCF to ask for documentation if my Claim lacks information that would help our company recover.

My complaint with the process so far is after filing with BP in June 2010, and the GCCF on August 27, 2010. I was never asked for additional information, nor was I asked any questions. I was denied on December 03, 2010.

According to what I have heard they have until the 15th of December to finish off all EAP claims , DOnt believe the call center they know NOTHING!

Did anyone see todays statistics? How can you go from 4 thousand and something under review back up to 8 thousand in one night? Did they relize they screwed up? But still seven days after I have sent in my information they say they have not recieved it!

I’ve been printing out the first page of the statistics page for a long time now and it looks like they are starting to try to cover their A^^ and make the figures to their advantage.  I’ve noticed small wording changes also in their final payment process page.  If they make a correction they need to state there was a correction.  So depending on the day you read the process you have the right one to go by. 

It will change another 100 times before the end of the whole process.

It’s like sitting in a casino, which I never do, watching our future depend on a roulette wheel.  So I’m in this game of chance, and I don’t like to gamble. 

I’m hoping that Mr Feinberg has recalled some of the denials due to his better judgement.  He didn’t get where he is without being smart.

I pray to our God, that everyone who deserves compensation will get it.

Just received word that a friend just received his EAP for $3000.00   This was based on solely of lost commissions for sales.  Not salary but commissions.  So now this opens the door for all those casino workers that are not being paid for lost tips..tips are calculated at a rate above their earnings on the taxes that is how the IRS gets their cut of tips.  Commissions and tips could be considered the same when calculating a loss.  Just wanted everyone to know that a commission base claim was paid through the GCCF.  I’m documenting every possible claim thats been paid.  I have a huge friend and customer base that have filed and I’m keeping pretty good track of the process.

Can anyone give me feedback if they made the horrific descion of picking month to month instead of the 6months at once. I know theres only a select few of us..I put my claim in on Aug 23and I received my first payment early Oct. The the first and only supplemental was received on Nov. 22.. All 5 were put in the day I received my first check but complications of them uploaded my five verbatim attachments of the front and back of the supplemental claim form was screwd up and only two got uploaded only for me to find out mid Nov. But my question is did anyone receive more than one supplemental and if so was it at once?? Thank you

  I have two people that filed for a month claim then did the month to month and both were paid the first month and then both waited for almost two months to receive a second check.  After that they went into detailed review then sadly they both were just given a denial.  Both are condo owners and do weekly rentals and they would file at the end of the month if no one rented and they showed a loss from the past year.  Feinberg is pushing for final claims to be signed..not hand out anymore EAP if possible..

  Denial and fraud, now my stomach is in knots because my daughters Xmas depends on these next checks and a roof over her head morey importantly . I am out of work 100% no cut back hours or clientell. Our waters still.closed I hope and pray this does not happen for Whatever reason I can’t wait for an interm.or final I’m hurting. I’m sorry to hear about your friends. Also just curious so your friend was paid then they claimed.it was fraud. Wow.. they let them know it was considered fruadulant?? That’s crazy.. he’s definitely making cutbacks before final claims…thank you

Yea it was in the news today that a woman claimed other other peoples manes including her dead sister and collected over 76,000 dollars and they are just now charging her she probably already had lots of fun with that money thats now gone from the reserve!
I was a oil spill worker this somer because my job laid me off. Did you know the company I worked for was a company that BP has monitor most of there plant and one day in 146 degree heat index they dropped 150 of us on a beach and destin then left! They never came back no water no bathrooms no place to stop we walked for 5 miles with some of us having to carry others because of them passing out. People also urinating on themselves. Be fore we could get help. They admitted to us all they made a horrible mistake and lost us. I endined up in the hospital with a UTI and the next day I was told I was placed on standby not because I got hurt my name was so called radomly picked! I was told those claims are not paid out!
