Post-Roe: Testing the Law

Ongoing legal battles are creating confusion among abortion patients and health care providers. Where do the laws stand now?

In the aftermath of the Supreme Court decision to overturn Roe v. Wade, the legal landscape has shifted rapidly, creating confusion among health care providers and patients. In more than a dozen states, trigger laws already on the books went into effect or lawmakers rushed to pass new, more restrictive laws that were promptly challenged with lawsuits. The resulting legal battles have created an unstable environment where abortion can be legal one day and illegal the next.

Amid the uncertainty, anti-abortion activists are pursuing a variety of novel legal tactics that could be used as model legislation at the state level. In one case reported by ProPublica, a woman’s ex-husband is suing a Phoenix clinic over an abortion she received more than four years ago. This is a rare tactic, but experts warn it could be a harbinger for things to come as legislators test new strategies to restrict abortion and intimidate abortion providers.
