Homeowners, Tell ProPublica About Your Wrongful Foreclosure

Have been dealing with alot when it comes to Loan modifications and foreclosure issues. I have decided to file bankruptcy to save myself. I know I should have been aproved for the modification! They now have the foreclosure sale date set for May 2nd. I will be at the court house to file bankruptcy papers this week. I even go online to see if I can find a deal on a foreclosed home. I go to a site and look up police auctions. OMG! My house and my husbands name was the first thing I saw listed for my area. Is my name allowed to be posted? Is my house allowed to be posted before the actual sale date? I have people driving by my home several times real slow.What are my rights? Should I check into this thing called forensic loan audit?

Help ProPublica with your info and data. Their format is excellent and with their resources I believe they will put forward a broad, accurate and sweeping expose’. Citi is diabolical. Vikram Pandit, Citi CEO, sat before congress in 2009 and said his mouthful. The process Citi has used to foreclose on me has no similarity whatsoever to what either he said in 2009 or his USA head man said the following year. If Citi is your servicer go google their testimony and you will be enraged at how you have been treated.

The banks caused the drop in prices and they are getting bailed out by us and we are getting squat.  google “100yearhomevalues”.LOOK AT THAT GRAPH !! those crooks did this to us…  No one should have to qualify for a modification.  They should simply drop the principal balance to the fair market value today and stabilize the housing market and prices.  Then adjust the interest rate for at least 5 years to make the home affordable.  That will give people a chance to recover and if they really can’t make the new payments they can sell without having to beg at the altar of the banks for a short sale.  The principal balance will already be at the fair market value….. MARK TO MARKET!!
if that happened the housing market could stabilize….

Chase closed my loan and I was locked out for 9 months did not have a certificate of occupancy and Chase said they funded in good faith audit determined that chase broke their regulator occ which is a joke and the loan should have never funded. chase is a predatory lender I can be reached at 561-732-0090.

Identity theives who had worked in a Mortage Finance company. I helped elderly people with getting moved to a relaxed climate (a front for a 18 USC 1341 violation). I had Countrywide then, Now Bac. I paid all the monies down and closing cost, they had children in two different prisons at the time, so I was supposed to be placed on the deed until they sold their other house, (It was my lawyer that done the closing but I wasn’t placed on the deed).  They then obtained a frauduent check to start auto debit from my personal account, and it didn’t come from me, (in late 2005). the same account and same mortage company that I had to Auto debit my home and had a $9K esgrow. Behind this were professional thieves and will obtain this property later, my family calls this scam the “Criminal retirement plan” I tried to stop the auto debit, the check which are false, both the bank and Countrywide said they would stop, but lied. More letters and the kids now out of jail, stold and forges about $180,000.00 from my 2ed mortage home equity line (provable.)  Countrywide, and BAC, were called and I began paying a full time accountant to do this, then I, at a different location, and different office concurrently bombarded the bank and mortage company with calls, in an effort to amicably reslove this. In late 2007 they stopped taking the monies and we began trying to get the near $30,000.00 back (the 9K still in esgrow) In early 2008 with open phones for others to hear they said they would credit me, we would deal with all the accountant cost at another time.  As all the letters to propublica they had lied to get me to stop paying to trap me into a forclosure, but this don’t apply, I had overpaid and no justification for all my overpayments, I was well over a year ahead on my payments by all counts.  BAC /Countrywide immediately move for forclosure in 2008, My attorney said forclosures are tough the only defense was “you have paid,” “fraud” and lack of jurisdiction and some contractural mistake (if lucky)  I moved the case to Federal Court under title15 USC 1692 unfair collections, basically if the bill collector lies. Not applicable to companies if their primary business isn’t bill collections. While Countrywide BAC have this collections as a separate corporation, I opted to dismiss the case and pursue it under Civil Rico (needing the mail or wire fraud (bank fraud) and you must be the intended target and have suffered actual loss.)
  But when returned to state court, I followed my attorney’s advice and merely asked where is the note, contract or proof that I would buy someone else a house, of course, they couldn’t provide that.  But the Attorney hired by BAC (now just BAC) filed a motion for default but didn’t send a copy to me until I had one day left to respond, and in my area, the first Monday of every month is when the court deals with forclosure.  They expected an entry, However, I filed in that one day with proof that I was ahead, at this time over $103,000.00 over paid.  (since they charge for fees, attorneys and accountants so can I, but mine was actual true cost)  The case wasn’t further pursued and was deposed of as the judge told me, I’m not sure why, probably failure to prosecute.
  Yesterday, after BAC slandering my credit as to forclosure, (and at this time I’m making no payments, I’m still ahead, and I’m curious what the interest is on forged wire frauded monies) I spoke with them 4 times, them recording, them saying they couldn’t, so I lied and said I wasn’t, since that is “all” they do.  (where do they clone these people from? liars and certified dirtbags) We postured before the conversation them saying you want me to “help save your home” (thats exactly what they wasn’t doing) I said you want to avoid litigation? (I’m filing in the next 4 days) So the person (me expecting the con) asked a number of questions and responded as I have explained above.  When I said I stopped paying when they told me to, she asked “if I had proof” (I was waiting for this) I said only an accountant and two other but not in writing.  She said I was in trouble and they were starting the (yes, this is the words she used) “Extraction process” as if I’m the vermen.  I said lady, whatever time I decided to stop “overpaying” whether by you’re lies or a little bird telling me, I’m still overpaid.  They have bilaterally and whole heartedly entered into the wire fraud scam.  I’m overpaid and with no justification as to why I can’t get credit for my monies drafted by them.  (inceridible I know), but reading the lies the services tell people to stop paying to get a Loan Mod then using that and making them inelligible, it’s all a land grab and this exemplifies what some people and lawyers are, but the lawyers aren’t as bad and the common folk who take these jobs and set people up for destruction, one proably lives on your block and will appropriately burn in hell.

With what has been uncovered of Banks wrong doing,none of them will sit in Jail.For years the Homebuyers were taken advantage of by these people,That’s why sometimes taken Justice into your own hands is the only way of getting results.

In 2001 my father past away he was a ex navy seal retired . This home was built by my ansesters. While my father was alive he developed damenta and was legaly blind . This so called morgage company Home American ,Upland Morgage and Latter Southwest Capital . Clamed my father that was blind with dementa took a 72,000 Dollar loan on a home that was worth only 52,000 . First my father had no reason to take out such loan , everything was paid for and he had his pention.. ? So when he pastaway i being his daughter and aier of the Estate I went through his paperwork and came across this payment book I called and to my suprise they clamed my father owed money .. Well I decided to pay them and with there advice rented it . I also filed for restatement. I then asked for all the paperwork my father signed for this loan , THIS is where the trouble started .. They soon stoped talking to me and went to my tenates and advised them to not pay me ..I took tenats to local court where they admi9ted that this is all true. They where ruled agenst . During this time thesrs morgage company clamed they forclosed on this home they bought for 100 dollars at the court house.. they broke into my home while i was gone and removed all of my familys things that came from poland and france .. I came back to find windows door pluming and gas busted.. Sence this the police through them off property and untill 2010 I being my father still owned home .. in 2010 they came up

with a deed that said they paid john jasek 45,000 ? Problem he has been dead for ten years .. and why would u put a quick clame if ur deed is valid from 06 ? going futher the signiture of john is not his and that has been proven .. Now we r stuck with a judge that will not allow this evidence into her court the Judge is ROMENO Now Bernett Clark of utica NY wont allow any evidence .. But the cour will alow us to pay a sum of 27,000 at a 24% interest and a baloon payment at the end ? FOLKS We as people hav no rights to due prosess it is a money game and we r here to loose

Here is a comment I found on the LA Times website re. lawyer fighting fraudclosure:

“I strongly disagree with State Bar Judge Richard Honn in his decision to revoke Michael T Pines license. The State Bar itself needs to be investigated. Why? Because it is part of the reason citizens victimized by Wall St’s egregious trading practices have been further victimized. Many turned to the State Bar and got zero help. Instead they encountered chaos, mis-management of their paperwork, and if ANYTHING they should be revoking the licenses of millions of attys representing the banks. Furthermore, the JUDGES OF THIS COUNTRY have been complicit in refusing to allow lawyers representing the families a/g the banks to put forth their cases by blocking them in a myriad of ways which by default allowed banks to steal homes by the millions. I personally sat in a court where Michael T Pines quoted California Supreme Court ruling, and the sitting Judge said, while waving his hand dramatically in the air, and I quote: “Oh that is the Supreme Court UP THERE.. they can afford to be lofty, we don’t agree with them down here…OVERRULED.” Our mouths fell on the ground… the Judge refused Micheal T Pine’s to be heard on behalf of his client, to follow Supreme Court precedent… this and many other ludicrous rulings by judges clearly Pro-Bank, clearly not interested in having these cases in their courtrooms in the first place, the lying under oath by the Banks’ hired zombies, forced Mr Pines to take the drastic steps he is now being once again punished for. Years from now, I can only hope the truth will come out and Mr Pines will be recognized for trying to fight an impossible battle in a corrupt court system, a corrupt country, a/g Bank Cartels that displaced millions of Americans, causing them great ill health, traumatized their children, and ruined not just our nation, but the global economy.”

MODIFICATION IS A LIE—-THERE IS NO MODIFICATION—-QUESTION EVERYTHING—-GO TO YOUR COUNTY RECORDERS OFFICE—-FIND OUT THE TRUTH YOURSELVES BECAUSE THE JUDGES, LAWYERS, GOVERNMENT, BANKS, WALL STREET ARE STILL TRYING TO COVER UP THE FRAUD OF SECURITIZATION OF THE MORTGAGES WHICH HAS CAUSED ALL ORIGINAL LOAN DOCS TO DISAPPEAR!!!  SOME (some), JUDGES ARE FINALLY DECLARING FRAUD ON THE COURTS!!!

Ya I’ve looked on a lot of sites . The latest thing is no matter what evidence we bring in the judge won’t hear it . My partner that has spent 3 years on this case put together a perfect case together proving fraudulent acts . Well all of my amendment rights are given up there is a gag order on my partner . The 25 of this month I have to go in front of the judge ... AND KEEP MY MOUTH Shut ....!!!!!!! The law has been broken the judge knows attorneys on both sides have said it is was but the judge ROMONO / CLARK of the Utica Supreme Court . Won’t hear it . So I ask who is the crook now

Chase Bank they are all liars and cheats. Did the forbearance thing Twice, not once but twice was guaranteed a loan mod but never received it. Called Chase about 30-40 times without receiving an answer from anyone, essentially they blew me off with dumb responses. Next thing i notice is a taped note on my front door that my house locks will be rekeyed because my house was forclosed upon. No prior notice received at all. I am a disabled veteran not looking for a hand out just to be treated fairly by a large corporation. Its the same old story the strong taking advantage of the weak.
